Since 2016, David Brett has assisted numerous individuals and businesses resolve and finalise potential or ongoing litigation, allowing them to move on with their day to day businesses and activities without the ongoing stress and cost of dealing with litigation or proposed litigation.
MEDIATION SERVICES
David Brett Dispute Resolution provides mediation services in a wide variety of commercial and property disputes. David Brett is an experienced mediator in commercial dispute areas including contractual disputes, joint ventures, banking, guarantees, trusts, franchises and insolvency. Insolvency disputes include disputes over preferential payments, uncommercial transactions, insolvent trading and breaches of directors' duties.
David also conducts mediations in property areas such as co-ownership disputes, commercial and retail lease disputes and disputes regarding claims in relation to ownership claims from constructive or resulting trusts.
David believes that, whilst in some circumstances, continued litigation is unavoidable, the majority of disputes can be resolved through a close examination of the issues, a greater understanding of the position of the other parties, a realistic consideration of a party's own position and a recognition of the costs, risk and perils of litigation. If there is any prospect that a matter can be resolved, it should be - it is normally in everybody's best interest.
ABOUT ME
David Brett is the principal of David Brett Dispute Resolution. David is a Nationally Accredited Mediator, an Accredited Commercial Litigation Specialist, and a Sessional Ombudsman in Banking & Finance for the Australian Financial Complaints Authority.
David is on a number of mediator panels, including the Victorian Small Business Commission, the Office of the Franchising Mediation Advisor and the Victorian Civil & Administrative Tribunal.
David continues to combine his activities as a mediator, a commercial litigation lawyer, and a Banking & Finance Ombudsman and believes that this provides him with a unique perspective which is of great benefit in assisting parties in reaching a resolution of their disputes.
